Writ petition against the government decision to allow import of vehicle against the will of Vehicular Mass Emission Standard 2056 [2001]

In 26 December 2001, LEADERS Nepal filed public interest litigation against the government for its decision to allow import of vehicle against the will of Nepal Vehicular Mass Emission Standard 2056 (NVSM). The case was filed in the Supreme Court. Supreme Court gave a stay order against the import of such vehicles that does not fulfill the NVSM 2056 rule. The NVSM 2056 rule requires importer to produce both “Type Approval” and “Conformity of Production Certificate” while importing any vehicle from any foreign countries. However, then Prime Minister Girija P. Koirala signed an agreement with the Indian Government to allow import of Indian Vehicles simply on the basis of “type approval”, which was against the spirit of NVSM 2056 rule.
